Term 20/21:
The participants will be informed on the basic comparative methods (functional and institutional comparative law), the aims of the comparative law. They should learn about the comparative law in the macro-and microscale. The students will learn about the criteria of the legal traditions' classification and about essential formants of the main legal families. There is a special stress on the mixed jurisdictions, being a sort of laboratory for the comparative law. It will be discussed the criticism on the comparative method from the persective of the de-constructivism. The proces of the unification of law as a practical field of the application of the comparative method will be presented. It will be also a discussion concerning the legal reasoning, also by judges, wit the usage of the comparative method. |
